Client Services Agreement

This Client Services Agreement (“Agreement”) governs all services provided by Bower Beauty LLC d/b/a Bower (“Bower,” “we,” “our,” or “us”) to clients and guests (“Client” or “you”). By booking an appointment or engaging services with Bower, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth herein. Bower reserves the right to modify this Agreement at any time; the most current version will be available on our website and supersedes all prior versions.
Part I — Booking, Scheduling & Cancellation Policy
1.1 Reservations & Deposits
A valid credit or debit card may be required to secure any appointment. By providing payment information at the time of booking, you authorize Bower to apply applicable cancellation or no-show charges as described below.
1.2 Cancellation & Modification
We require a minimum of twenty-four (24) hours’ advance notice for all cancellations or appointment modifications. The following fees apply:
- Late Cancellation (less than 24 hours’ notice): up to fifty percent (50%) of the scheduled service fee.
- No-Show (failure to arrive without notice): up to one hundred percent (100%) of the scheduled service fee.
Bower reserves the right to waive fees at its sole discretion in cases of genuine emergency. All fees are final and non-refundable once assessed.
1.3 Arrival & Late Arrivals
Clients are encouraged to arrive a few minutes prior to their scheduled appointment time. If you arrive late, your service time may be reduced to accommodate subsequent bookings, and the full service fee will remain due. Bower shall not be liable for any diminished service experience resulting from a late arrival.
1.4 Group Bookings
Group reservations of three (3) or more guests require a valid card on file at the time of booking. Individual no-shows within a group may each be charged the full fee for their scheduled service. Modifications to group reservations will be accommodated where operationally feasible.
Part II — Payments, Pricing & Gift Cards
2.1 Payment Terms
Full payment is due at the time services are rendered. Bower accepts major credit cards and approved digital payment methods. Personal checks are not accepted. Bower reserves the right to update accepted payment methods at any time.
2.2 Pricing
All service prices are subject to change without prior notice. Current pricing is available at our studio and on our website. Quoted prices are not guaranteed beyond the date of quotation.
2.3 Service Adjustments & Refund Policy
All completed services are final and non-refundable. If a Client is not fully satisfied, please contact Bower within forty-eight (48) hours of the appointment. At its sole discretion, Bower may offer a complimentary adjustment or correction for services that fail to meet reasonable professional standards. Refunds will not be issued for completed services under any circumstances.
2.4 Gift Cards
Gift cards are available for purchase and may be applied toward services and retail products at Bower. The following terms govern gift card use:
- Gift cards are non-refundable and may not be redeemed for cash, except where required by applicable state or federal law.
- Gift cards may not be applied toward gratuity, cancellation fees, or no-show charges.
- Gift cards purchased in Tennessee are valid for a minimum of twenty-four (24) months from the date of purchase, and shall not expire where prohibited by law.
- No inactivity, maintenance, or dormancy fees will be assessed.
- Where required by applicable law, gift cards with a remaining balance below a state-defined threshold may be redeemed for cash upon written request.
- Bower is not responsible for lost, stolen, or damaged gift cards. Replacement may be issued, at Bower’s discretion, upon presentation of satisfactory proof of purchase and verification of remaining balance.
Part III — Health, Safety & Studio Conduct
3.1 Health & Safety Conditions
Bower reserves the right to decline, postpone, or discontinue any service where a Client presents with signs of infection, open wounds, communicable conditions, skin disorders, or any condition that may compromise the health or safety of the Client, other guests, or staff. Such determinations are made at the sole discretion of Bower’s licensed professionals. Clients are responsible for disclosing any known allergies, skin sensitivities, medical conditions, or recent procedures prior to service. Bower shall not be liable for adverse reactions arising from a Client’s failure to disclose relevant health information.
3.2 Right to Refuse Service
Bower reserves the right to refuse service to any individual at its sole discretion, including but not limited to circumstances involving: (i) inappropriate, abusive, or threatening conduct toward staff or guests; (ii) repeated late arrivals or cancellations; (iii) violation of studio policies; or (iv) any condition presenting a health or safety concern. No refund or compensation shall be owed in connection with a good faith refusal of service.
3.3 Guest Experience & Studio Etiquette
To preserve a calm and considerate environment for all guests, we kindly request that mobile devices be silenced or set to vibrate while in the studio. Clients are expected to treat all staff and fellow guests with courtesy and respect. Bower reserves the right to ask any guest who disrupts the studio environment to leave.
3.4 Alcohol Service
Where alcohol is offered, consumption is strictly limited to guests who are twenty-one (21) years of age or older and who provide valid identification upon request. Bower reserves the right to refuse alcohol service at its sole discretion, without obligation to provide a reason.
Part IV — Limitation of Liability & Indemnification
4.1 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOWER BEAUTY LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY SERVICE, PRODUCT, OR INTERACTION WITH BOWER, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF BOWER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BOWER’S TOTAL LIABILITY TO ANY CLIENT EXCEED THE AMOUNT ACTUALLY PAID BY THAT CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
4.2 Personal Belongings
Bower is not responsible for the loss, theft, or damage of any personal belongings brought onto the premises. Clients are advised to secure valuables prior to their appointment. Bower expressly disclaims all liability for personal property.
4.3 Service Results
Individual results from beauty and nail services vary based on a Client’s natural characteristics, health, lifestyle, and adherence to aftercare instructions. Bower makes no guarantee or warranty, express or implied, regarding the outcome, longevity, or suitability of any service for any particular Client.
4.4 Indemnification
By engaging Bower’s services, the Client agrees to indemnify, defend, and hold harmless Bower Beauty LLC and its members, managers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) the Client’s breach of this Agreement; (ii) the Client’s misrepresentation of health or other material information; (iii) any act or omission of the Client on Bower’s premises; or (iv) the Client’s violation of any applicable law or third-party rights.
4.5 Force Majeure
Bower shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, public health emergencies, governmental orders, labor disputes, or utility failures.
Part V — Privacy Policy
5.1 Information We Collect
In the course of providing services, Bower may collect the following categories of personal information:
- Identification and contact data: name, email address, phone number, and mailing address.
- Appointment and service history, preferences, and consultation records.
- Payment information, processed securely through third-party payment platforms (such as Square or Vagaro); Bower does not store full payment card data on its systems.
- Communications submitted via email, phone, text, in studio forms, or client profiles.
- Technical data automatically collected via our website, including IP address, browser and device type, pages visited, session duration, and referral source.
5.2 How We Use Your Information
Bower uses collected information solely for the following purposes:
- Scheduling, managing, and confirming appointments.
- Delivering and personalizing services.
- Processing payments and maintaining financial records.
- Sending service related communications, including confirmations and reminders.
- Sending marketing communications and promotions, only where the Client has affirmatively opted in.
- Improving service quality, operational efficiency, and the overall guest experience.
- Complying with applicable legal obligations.
5.3 Sharing of Information
Bower does not sell, rent, or trade personal information to third parties. We may share information with trusted service providers who assist in operating our business, such as scheduling software and payment processing platforms, strictly for business purposes and subject to confidentiality obligations. We may also disclose information as required by law, court order, or in response to valid legal process.
5.4 Cookies & Website Tracking
Our website uses cookies and similar tracking technologies to enhance functionality and analyze site usage. These tools may collect IP addresses, pages visited, session duration, device information, and referral sources. We may utilize analytics tools (such as Google Analytics) and limited advertising technologies. You may disable cookies through your browser settings; however, doing so may affect certain website features. Bower will always present cookie preference options and will honor your selections.
5.5 Your Privacy Rights
Subject to applicable law, you have the right to: (i) access the personal information Bower holds about you; (ii) request correction of inaccurate information; (iii) request deletion of your personal information; and (iv) opt out of marketing communications at any time. Requests may be submitted to info@bowernails.com. We will respond within a reasonable time and in accordance with applicable law.
5.6 California Privacy Rights
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) or other applicable state privacy laws, including the right to know, the right to delete, and the right to opt out of the sale or sharing of personal information. 5.7 Data Security
Bower employs commercially reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no data transmission or storage system can be guaranteed to be completely secure. Bower shall not be liable for any unauthorized access to personal information resulting from circumstances beyond its reasonable control.
5.8 Third-Party Links
Our website may contain links to third-party websites. Bower is not responsible for the privacy practices, content, or security of any external websites, and this Agreement does not govern such sites. We encourage you to review the privacy policies of any third-party sites you visit.
5.9 Children’s Privacy
Bower’s services and website are not directed to individuals under the age of thirteen (13). We do not knowingly collect personal information from minors. If you believe a minor has submitted information to us, please contact us at info@bowernails.com and we will promptly take corrective action.
Part VI — Communications Consent (SMS & Email)
6.1 SMS Communications
By providing a mobile phone number to Bower and opting in to text message communications, you consent to receive SMS messages from Bower, which may include appointment confirmations, reminders, service updates, and, if you have opted in, promotional content. The following terms apply:
- Message frequency will vary based on appointment activity and preferences.
- Standard message and data rates may apply depending on your mobile carrier and plan.
- You may opt out of SMS communications at any time by replying STOP to any message. Following opt-out, you may receive a single confirmation text.
- For assistance, reply HELP or contact us directly at info@bowernails.com.
- Consent to receive SMS messages is not a condition of purchasing any service or product from Bower.
6.2 Email Communications
By providing your email address, you consent to receive service-related communications from Bower. If you opt in to marketing communications, you may receive occasional promotional emails. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link included in each email or by contacting us directly. Bower will not sell or share your contact information for third-party marketing purposes.
Part VII — General Provisions
7.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOWER BEAUTY LLC AND THE CLIENT EACH KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES PROVIDED HEREUNDER. Each party acknowledges that this waiver is a material inducement to entering into this Agreement and that it has had the opportunity to consult with counsel prior to agreeing to this waiver.
7.2 Dispute Resolution
In the event of a dispute arising out of or related to this Agreement or the services provided by Bower, the parties agree to first attempt to resolve the matter informally by contacting Bower at info@bowernails.com. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue available legal remedies. Any claim or cause of action arising out of or related to services provided by Bower Beauty LLC, this Agreement, or any interaction with Bower must be commenced within six (6) months of the date on which the claim accrued, or the date on which the Client knew or reasonably should have known of the basis for the claim, whichever is earlier. Any claim not brought within this period shall be permanently barred, regardless of any longer period that may be permitted by applicable statute of limitations. The Client expressly waives any right to assert a claim outside this period.
7.3 Waiver and Release of Claims
In consideration of receiving services from Bower Beauty LLC, the Client knowingly and voluntarily waives, releases, and forever discharges Bower Beauty LLC and its members, managers, employees, contractors, and agents from any and all claims, demands, actions, or causes of action, known or unknown, foreseen or unforeseen, arising out of or related to any service performed by Bower, including but not limited to claims arising from allergic reactions, skin or nail damage, dissatisfaction with service results, or personal injury occurring on Bower’s premises. This waiver and release is intended to be as broad as permitted under applicable Tennessee law.
7.4 Severability
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from this Agreement, without affecting the validity and enforceability of the remaining provisions.
7.5 Entire Agreement
This Agreement constitutes the entire agreement between Bower Beauty LLC and the Client with respect to its subject matter and supersedes all prior agreements, representations, and understandings, whether written or oral.
7.6 Policy Updates
Bower reserves the right to amend this Agreement at any time. Updated terms will be posted on our website with a revised effective date. Continued engagement with Bower’s services following any such update constitutes acceptance of the revised Agreement.
